Arc Dev Subscription Terms & Conditions

These Subscription Terms & Conditions (“Terms”) form a legally binding agreement between Arc Dev Pty Ltd ("Arc Dev", "we", "us", or "our") and you (“Subscriber”, “you” or “your”) for access to our digital products, services, and platforms.
1. Definitions
- Subscription: Ongoing access to Arc Dev’s services in exchange for recurring payment.
- Billing Cycle: The regular interval at which payments are due (e.g., monthly).
- User: An individual or entity that registers for and/or uses Arc Dev services.
- Service: Any software, platform, tool, or digital product provided by Arc Dev.
- Free Trial: A limited period of free access to a paid Service.
2. Subscription Plans & Features
We offer multiple subscription plans tailored to different needs. Plan features, limits, and pricing are listed on our website or service portal. These may include:
- Tiered pricing based on usage
- Free and paid plan options
- Add-on features or modules
Your access is subject to the terms of the plan you selected.
3. Free Trials
If applicable, we may offer a free trial for a specified duration. After the trial:
- You will be automatically upgraded to a paid plan unless you cancel before the trial ends.
- We will notify you before charging any fees.
You may only use one free trial per product or account unless otherwise agreed.
4. Billing & Payment Terms
- All subscriptions are billed in advance on a recurring monthly basis.
- Payments must be made via approved methods (e.g., credit/debit card, EFT).
- All pricing is in ZAR and includes VAT unless otherwise stated.
- Late payments may result in account suspension after a grace period of 15 days.
5. Renewals & Cancellations
- Renewals: Subscriptions auto-renew unless cancelled before the end of the current cycle.
- Cancellation: You may cancel anytime via your account settings. Your access remains valid until the end of the paid period.
- We do not lock users in — no hidden cancellation fees.
6. Refunds & Grace Periods
- Arc Dev offers pro-rata or full refunds only if:
- There was a billing error.
- You cancel within 7 days of the first payment (first-time users only, and at our discretion based on usage).
- No refunds for partially used billing cycles unless required by law.
7. Usage & Fair Use Policy
You agree to use the Service fairly and lawfully. We may restrict or suspend usage if:
- You intentionally abuse the system (e.g., spamming, denial of service).
- You exceed limits in a way that degrades service for others.
- You engage in harmful behavior (technical or social).
We aim to resolve such issues respectfully and transparently.
8. Modifications to Service or Pricing
We may make reasonable changes to:
- Service features (e.g., upgrades, improvements)
- Subscription fees
You will be notified at least 30 days in advance of any material pricing changes. Continued use after changes implies acceptance.
9. User Responsibilities
You must:
- Keep login credentials secure.
- Comply with applicable laws (e.g., POPIA).
- Ensure accurate billing and contact information.
- Not use the service for unlawful or unauthorized purposes.
10. Termination & Suspension
We may suspend or terminate access:
- For non-payment after 15 days.
- If you violate these Terms materially.
- If required by law or regulation.
You may terminate the subscription at any time via your dashboard.
11. Data Ownership & Privacy
- You retain ownership of all data you input.
- We act as a data operator and comply with the Protection of Personal Information Act (POPIA).
- As long as your account is active, your data is retained for the service. Upon account termination or deletion, all your data will be deleted immediately and cannot be recovered.

12. Limitation of Liability
To the fullest extent permitted by law:
- Arc Dev is not liable for indirect, incidental, or consequential damages.
- Our total liability is limited to the fees paid in the past 6 months.
- This does not limit your rights under the Consumer Protection Act.
13. Dispute Resolution
- We aim to resolve concerns through friendly engagement.
- If unresolved, disputes will be handled via mediation first.
- If mediation fails, then arbitration under the laws of South Africa.
14. Governing Law
These Terms are governed by the laws of the Republic of South Africa, particularly the Consumer Protection Act (CPA).

16. Acceptance

- This version supersedes and replaces all prior Arc Dev Subscription Terms & Conditions, unless expressly stated otherwise in writing.
